Terms of Use
Effective Date: January 15, 2025
Welcome to Cognaxia. These Terms of Use govern your access to and use of our educational platform, which focuses on game mechanics and 3D design training. By accessing cognaxia.com or participating in our programs, you acknowledge that you've read and accepted these terms.
We've written this in straightforward language because legal documents don't need to be confusing. If something isn't clear, reach out to us at support@cognaxia.com.
1 Acceptance and Modification
Using our platform means you're agreeing to these terms. Simple as that. We might update these terms occasionally as our programs evolve or legal requirements change. When we do, we'll post the new version here with an updated date at the top.
Significant changes? We'll send you an email notification at least 15 days before they take effect. Continuing to use Cognaxia after changes go live means you're okay with them. If you're not, that's fine—just stop using the platform before the changes kick in.
2 Eligibility and Account Registration
You need to be at least 18 years old to create an account. If you're under 18 but want to learn with us, your parent or legal guardian needs to create the account and supervise your participation.
Account Security
When you register, you'll create login credentials. Keep these private. You're responsible for any activity that happens under your account. If you notice something suspicious or think someone else accessed your account, let us know immediately.
Don't share your account with others. Each student should have their own individual account to track progress accurately and maintain program integrity.
We reserve the right to suspend or terminate accounts that violate these terms or engage in behavior that disrupts other students' learning experience.
3 Educational Services and Program Structure
Cognaxia provides educational content focused on game mechanics and 3D design. Our programs typically run for several months, with cohorts starting in autumn 2025 and continuing into 2026.
What We Provide
- Access to course materials, video tutorials, and project files during your enrollment period
- Instructor feedback on submitted assignments and projects
- Access to our learning community and peer discussion forums
- Technical support for platform-related issues
What We Don't Promise
We design our programs to teach practical skills, but we can't guarantee specific career outcomes, employment opportunities, or income levels. Your success depends on your effort, practice time, prior experience, market conditions, and many other factors outside our control.
Program schedules and instructor availability may occasionally change. We'll do our best to notify you in advance of any significant modifications to your enrolled program.
4 Payment Terms and Refunds
Program fees are listed on our website and must be paid before accessing course materials. We accept payment through the methods specified during enrollment.
Refund Policy
You have 14 days from your enrollment date to request a full refund if you haven't accessed more than 20% of the course materials. After this period, or if you've accessed more than 20% of the content, refunds are not available.
To request a refund, email support@cognaxia.com with your account details and enrollment date. We'll process approved refunds within 10 business days.
Special promotions or discounted enrollments may have different refund terms, which will be clearly stated at the time of purchase.
5 Intellectual Property Rights
All course materials, videos, tutorials, software, graphics, and documentation provided through Cognaxia are protected by copyright and other intellectual property laws. We or our content creators own these materials.
Your License
When you enroll, we grant you a limited, non-exclusive, non-transferable license to access and use course materials for your personal educational purposes. This means you can watch videos, download project files, and use resources to learn—but you can't redistribute them, sell them, or share them publicly.
Your Work
Projects you create using skills learned at Cognaxia belong to you. We may request permission to showcase student work in our portfolio or marketing materials, but we'll always ask first and credit you appropriately.
6 User Conduct and Community Guidelines
Our learning community works best when everyone treats each other with respect. We expect professional and courteous behavior in all interactions—forums, project feedback, live sessions, and direct messages.
Prohibited Activities
- Harassing, threatening, or bullying other students or instructors
- Posting spam, advertising, or promotional content without permission
- Sharing course materials, login credentials, or proprietary resources outside the platform
- Attempting to hack, disrupt, or damage the platform infrastructure
- Submitting plagiarized work or claiming others' projects as your own
- Using the platform for any illegal activities or purposes
Violations can result in warnings, temporary suspension, or permanent account termination depending on severity. Serious violations may be reported to appropriate authorities.
7 Privacy and Data Protection
We collect and process personal information as described in our Privacy Policy. Operating in Spain, we comply with GDPR and other applicable data protection regulations.
We use your data to provide educational services, communicate about your program, improve our offerings, and fulfill legal obligations. We don't sell your personal information to third parties.
You have rights regarding your personal data, including access, correction, deletion, and data portability. Contact support@cognaxia.com to exercise these rights.
8 Technical Requirements and Platform Access
Cognaxia is an online platform. You need a reliable internet connection and compatible device to access course materials. Most modern browsers work fine, but we recommend Chrome, Firefox, or Safari for the best experience.
Platform Availability
We aim to keep the platform available 24/7, but occasional maintenance or technical issues happen. We're not liable for temporary interruptions, though we'll work quickly to restore service.
For extended planned maintenance, we'll notify you at least 48 hours in advance when possible.
9 Disclaimers and Limitations of Liability
We provide educational content "as is" and make reasonable efforts to ensure accuracy and quality, but we can't guarantee that our courses will meet every individual's specific needs or expectations.
Cognaxia is not responsible for career outcomes, job placements, income changes, or business results that may or may not occur after completing our programs. Educational value depends on many factors including individual effort, market conditions, and prior experience.
To the maximum extent permitted by law, Cognaxia and its instructors are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform or participation in programs.
Our total liability for any claims related to your use of Cognaxia shall not exceed the amount you paid for the specific program giving rise to the claim.
10 Third-Party Services and Links
Our platform may integrate with or link to third-party services, tools, or websites. We use these to enhance your learning experience—things like video hosting, payment processing, or software tools.
We don't control these third-party services and aren't responsible for their content, privacy practices, or terms. When you use them, their own terms and policies apply.
11 Termination
You can stop using Cognaxia anytime by not logging in. If you want to formally close your account, contact us at support@cognaxia.com.
We reserve the right to suspend or terminate your access if you violate these terms, engage in behavior that harms other users, or for other legitimate reasons. If we terminate your account for cause, you won't receive a refund for unused portions of your program.
After termination, you lose access to course materials and the learning platform. Provisions of these terms that should reasonably survive termination will continue to apply.
12 Governing Law and Dispute Resolution
These terms are governed by the laws of Spain. Our physical location is in Málaga, and Spanish law applies to any disputes that arise.
If we have a disagreement, let's try to resolve it directly first. Contact us at support@cognaxia.com and we'll work with you to find a solution.
If direct resolution doesn't work, disputes will be handled through the courts of Málaga, Spain, or through binding arbitration if both parties agree to that process.
13 General Provisions
If any part of these terms is found to be unenforceable, the rest remains in effect. Our failure to enforce any provision doesn't waive our right to enforce it later.
These terms constitute the entire agreement between you and Cognaxia regarding platform use and supersede any prior agreements or understandings.
You can't transfer your rights or obligations under these terms to anyone else without our written consent. We can transfer our rights and obligations to another entity if needed.
By using Cognaxia, you confirm that you've read, understood, and agreed to these Terms of Use. Last updated January 15, 2025.
